Wedding terms and conditions

Introduction

I am committed to your wedding day experience being a great one. Through proper planning and scheduling on the wedding day, everything should run smoothly. Set out below are some terms and conditions that apply to the services I will provide. By accepting the service, you agree to these terms.

Details on booking form 

Please check that all details are correct on the booking form. You will be solely responsible for any problems that arise because information or the booking form is wrong. 

Artistic Licence

We will agree a plan for the day, but you give me full discretion in relation to photographs taken during the course of the event, including suggested poses and locations to be used.  

Coverage

I will try to photograph all individuals you specify, but this may not always be possible.  Any special requests for group photos should be agreed in writing before the event. I will do my best to make sure these are fulfilled.

Access

The better access I get, the better range of photos I’ll be able to take. You agree that I can’t be held responsible for a lack of coverage if you or other members of the wedding party are not ready on time, or if restrictions are placed on what I can do by officials at the venues. For example, the area from which I am able to take photos may not be my choice and you accept that I can’t be held responsible for any obstructed view in these circumstances.

Weather and/or delays 

Weather permitting, the photographs will be taken in accordance with the agreed plan. If there is bad weather, I will work with you to make the necessary changes to the plan so that we get the best possible coverage in the time permitted.  You understand that a lack of natural light may impact on the coverage and quality of photos I can achieve. 

Colour Balance and Enhancements

I will do my best to provide pleasing colour balance based on the flesh tones of the subjects, but I cannot guarantee exact colour matching. It is sometimes impossible to record on file the exact colour of a garment as seen by the human eye. Due to a variety of lighting conditions and the limitations of digital sensors, some colours may alter throughout a set of photographs.  I may retouch and manipulate images at my discretion to enhance the photos.  

Delivery 

Images of the event will be ready, normally 2-6 weeks after the wedding day (depending on workload). 

Copyright

Your rights to reproduce or authorise reproduction of photographs I take will depend on the package you chose to purchase. Unless otherwise specified in the booking form, you will always have the right to make prints and share the photographs you receive for your own personal use. I will retain all copyright in the photographs in accordance with the Copyright, Designs and Patents Act 1988 and you will need my permission to use any photographs for commercial purposes.  Infringement of copyright is unlawful and might be a criminal offence. 

Display

From time to time I may use a photograph covered by this agreement to generally promote my services, including in advertising, brochures, magazine articles, websites, social media sites and sample albums. You agree that I may use your photographs for these purposes. 

Prices and Payments

A non-refundable booking fee of £250.00 is required to secure your booking. The booking fee will be deducted from your chosen package when calculating the final balance due. Payment in full of the remaining balance will be due one calendar month before the day of your event. Additional photos or CDs must be paid for in full at the time of ordering. 

Technical Failure and Force Majeure

Although all equipment is checked regularly and reasonable steps are taken to ensure backup equipment is available, you understand and agree I will not be responsible for photographs that are not produced due to technical failure. If an event beyond my reasonable control occurs which prevents me from attending, including illness, injury or flooding etc., I will endeavour to put you in touch with another photographer. If I cancel, or in the very unlikely event of total photographic failure, I will give you a full refund. 

Limitation of Liability 

I will endeavour to provide you with a great service but very occasionally things can go wrong. You acknowledge and agree that my total liability is limited to the amount which you have paid me for the services, unless a higher liability limit has been agreed in writing in advance for an additional fee. I will have no liability for indirect or consequential loss.  

Cancellation Fees

A cancelled booking can mean a lost days work for me. Depending on when you cancel, the following fees will be payable: 

More than three months before the event: the booking fee  

Less than three months before the event: £500.00

If you wish to change your wedding date after making a booking, providing I am available for the new date, any monies paid will go towards the new date. This must be done in writing.

On The Day 

You agree that I will be the only authorised and official photographer for the event.  I may bring along a second photographer or assistant to help me.

Personal Accident

Any directions or suggestions I give to you, your guests or employees during a photographic shoot are accepted at the persons own risk. You agree that I can’t be held responsible for any personal accidents that might occur during a photographic shoot. 

Insurance

I maintain full Public Liability and Professional Indemnity insurance.

Privacy

Any information you provide will be treated confidentially and will not be shared with others without your permission.

Entire Agreement and Variation

This agreement constitutes the entire agreement between me and you in relation to the services I will provide under the booking form. No variation or modification to this agreement will be effective unless agreed between me and you in writing. 

Defined Terms

In this agreement, the following words have these meanings:  “I”, “me” or “photographer” means Terri du Bois, trading as du Bois Photography; “you” means the person(s) identified on the booking form; “booking form” means the booking form for the services I will provide; “agreement” means the booking form and these terms and conditions; “services” means the services I will provide, as described in the booking form; “event” means the event described in the booking form.
